Tax Resistance - The Moral and Legal Defense

Our country, founded on the principles of liberty and independence, is no longer our country, but instead has been hijacked by a group of con men who play politicians, bankers and businessmen who trample over our civil liberties and sell our independence to the highest bidder, both foreign or domestic.

Today, corporations, not the people, write our laws and leave the needs of the nation to waste while money is spent for bombs and bullets and concentration camps. During the Bush years, the elections were stolen wantonly and openly and the mainstream media helped facilitate the fraud. During those years, Americans have seen their retirements funds stolen, the nation's treasure pillaged, their jobs outsourced, their infrustructure dismantled, and their country plunged into a never-ending war crafted by Machiavellian-Neocon minds controlling the White House.

Today, under the Obama administration, it looks like Americans will get no respite as the people controlling Obama have more piracy in mind and have gone at it in earnest with never ending taxpayer bailouts of financial institutions and banks. Congress, beholden to these same interests, have shirked their duties to represent the people and have colluded with the hijackers by passing unconstitutional laws like the Patriot Act, the Military Commissions Act, the John Warren Defense Appropriation Act, and countless others laws that will further erode our liberties and freedoms.

Isn't tax resistance the least we could do in light of all these injustices? When do we start expressing outrage (as well as freedom and bravery) by stopping the blood money spigot which is financing this rogue state? Just when do we decide to pull the plug on this illegal war that we were lied into and that has already killed over a million people? Just when do we stop paying our legislators who are actively working to destroy the U.S. Constitution? Just when do we stop funneling our tax dollars to be used to build concentration camps here in the United States for our own enslavement? Just when do we stop aiding and abetting torture?


At what point do we say enough is enough!?

These are the moral arguments to not pay federal taxes, but, for those of you who are worried that you are breaking the law by not paying the feds, rest assured that the very law itself says that you have no legal obligation to pay if you know that these taxes will be spent in the commission of a crime.

For instance, if you know that the government is breaking domestic and international law, and we have ample proof that they are, see: "Summary of International and U.S. Law Prohibiting Torture and Other Ill-treatment of Persons in Custody"; "US War Crimes During the Gulf War," by Francis Boyle ; "A Chronology of US War Crimes & Torture, 1975-2005" it is incumbent upon you to resist these crimes by refusing to finance them because, according to U.S. law, if you don't, you will be considered criminal liability and subject to prosecution.

According to our legal system when a person kills someone in the process of committing a crime, his accomplice (who wasn't directly involved in the killing) would be just as guilty as his partner who pulled the trigger. It doesn't matter that the accomplice didn't actually do the killing or that he might have objected to the use of such violence, to the U.S. legal system he is just as liable for murder as his partner and would be charged with 1st or 2nd degree murder.

Here is the definition of an "accomplice" in the legal dictionary:
"One who knowingly, voluntarily, and with common intent unites with the principal offender in the commission of a crime. One who is in some way concerned or associated in commission of crime; partaker of guilt; one who aids or assists, or is an Accessory. One who is guilty of complicity in crime charged, either by being present and aiding or abetting in it, or having advised and encouraged it, though absent from place when it was committed, though mere presence, Acquiescence, or silence, in the absence of a duty to act, is not enough, no matter how reprehensible it may be, to constitute one an accomplice. One is liable as an accomplice to the crime of another if he or she gave assistance or encouragement or failed to perform a legal duty to prevent it with the intent thereby to promote or facilitate commission of the crime."

I don't think it gets anymore explicit than that. The law is unambiguous: If you knowingly give assistance, or encouragement, or failed to perform a legal duty to prevent the commission of a crime, you are liable as an accomplice to that crime. So, when we send Federal taxes off to the state, and and we know the money will be used on an illegal war, and to pay torturers, and to destroy our Constitution, we are breaking the law and can be held accountable.

Once again, the law is unambiguous, you would be breaking the law by being an accomplice to a crime by paying your federal taxes.

Now, many tax resisters are using various constituional arguments to not pay taxes. Some use the excuse that the 16th Amendment was never ratified, therefore, it is null and void; others say that tax laws only stipulate paying taxes made on certain profits, but not on income derived from labor. There may be some validity to these arguments, but I believe that we need to take a moral stance similar to what Henry David Thoreau would have advocated in "Civil Disobedience." It's one thing to say that taxes are wrong because it wasn't codified, or was misused in a legal document, and another to say that taxes are wrong because they are being used to commit morally reprehensible and illegal acts.

The added bonus to this moral/legal argument is that it is unimpeachable in its logic: One doesn't have to be a tax law/Constitution scholar to argue the "accomplice to a crime" defense.

Please obey the law and refuse to be an accomplice to a crime. Stop paying your federal taxes.

BE SURE TO PAY YOUR TAXES. We are all hostages to psychopathic serial killer terrorists who have stolen our country through fraudulent elections and are posing as our government. They need your money to finish killing off America and start World War III.

BE SURE TO PAY YOUR TAXES, so they can afford to invade other independent nations, blow the arms off of babies, shoot their parents in the head, rape their 10-year-old sisters, and steal their national resources.

BE SURE TO PAY YOUR TAXES because without YOUR MONEY they will just go find some other bunch of suckers to enslave. They need your money. It takes a lot of money to hold a nation hostage. Just look at Iraq. It costs a lot to protect themselves from you. Good brainwashing programs are not cheap.

BE SURE TO PAY YOUR TAXES because “good roads” and “feeling safe” are more important than freedom and we all have to “do our part” to “spread democracy”, and to obey whatever other sound bites are planted in your brain. And besides, it’s expensive to pay guys to strip search your grandma at the airport.

REMEMBER: The “law” applies to YOU, not THEM.

Sad too say that this would only work if everyone refused to pay taxes.

Since that won't happen the only other way to go would be to totally abolish the IRS.

Illegal taxes paid for by illegal money, yet another infringement on our rights by the gov't. Add it to the ever-growing list of violations:
They violate the 1st Amendment by opening mail, caging demonstrators and banning books like America Deceived (book) from Amazon.
They violate the 2nd Amendment by confiscating guns during Katrina.
They violate the 4th Amendment by conducting warrant-less wiretaps.
They violate the 5th and 6th Amendment by suspending habeas corpus.
They violate the 8th Amendment by torturing.
They violate the entire Constitution by starting 2 illegal wars based on lies and on behalf of a foriegn gov't.
Impeach them all and save this great country.

Every taxpayer should file for an extension. This would boggle the IRS. When you bill comes, request a payment plan. According to IRS rules neither approach is a crime.
What would they do if 1 million taxpayers did this?

A major problem is that the few of us who do refuse to pay eventually get squished by the PTB, and any atttempts to actively organize are just as brutally taken down. The judiciary is no longer the friend or defender of the people and work in conjunction with the DOJ and the heavy handed goons of the collection dept.

Even with mountains of corroborating evidence, laws statutes, regulations, citations and brilliant legal briefs very few if any win, although there are a few recent victories, but I am beginning to suspect that those are setups to draw out more "rebels".

IMHO, a better approach is to use all of the various mechanisims and loopholes built right in to the current code by the the elite who also use those methods to eliminate or greatly reduce any tax obligations, plus by doing that you don't have to face the possibility of armed agents making a raid on your home and business, which beleive me is not a good time. Not to mention the enormous financial cost of penalties, interest, legal fees, in addition to incredible pressure on the family unit. These people don't care if your family disinegrates or if you end up in bankruptcy, so long as they get their pound of flesh.

The problem with using the various mechanism and loopholes is that you are playing their game when you do so. You are also hiding the fact that you are tax protesting so you can spotlight gross injustices. So, why do this at all? You might as well just go along an pay your taxes. Also, loopholes will get changed if enough people use them (except of course if you are wealthy and connected and have a friend in congress).

By the way raids by armed IRS agents are extremely rare according to tax resisters groups. They just like to mail you notices of fines or levies on your employment checks. They don't have the manpower nor to they want the negative publicity of going after people protesting torture and the war.

I agree, tax protesting is not easy but there are things you can do to not comply and that is you could take as many exemptions as you can on your W2. Here are other suggestions by a woman who has been tax protesting for years.

Interesting insight of how our government is run. With so many changes going on I agree that at times it might feel like we are departing from our traditions, but remember it takes thousands to win a war, but it takes just one man to start a revolution. We all want positive change, but how many of us are willing to take a stand for it?

Why don't you pay the taxes on the portion of the federal government expenditure that is unrelated to illegal war or illegal activities? Could that be anymore complicated that hiding from the IRS and the reducing of work options?

Otherwise, I don't quite buy your claim that you aren't paying your taxes for moral or legal reasons. Buy the way, no judge will prosecute you for paying taxes despite your argument.

The income tax isn't about raising funds - it's about controlling the "value" of worthless paper money by controlling how much of it you get to keep. The courts have ruled that it doesn't matter if you disagree with how they spend the "money" collected. Morally, I agree with you, however.

People tell me Health Care is a "right." They aren't talking about going to the doctor - they're saying someone else should pay their medical bills. People aren't ready to take responsibility for their own bills, much less their own lives.

No, most people are content being taxed to death as long as someone else takes responsibility for their actions. As long as they have some "toys" and the illusion of ownership there is no need (in their minds) for change.

Sadly, I fear things will get much worse before people actually take any real action.

BTW, I've battled the IRS - won a few, lost only one. It's not fun, but certainly educational. If everyone fought them I think it would overwhelm them and they'd ultimately have to give up.

Liberal democrats, politicians and citizens are generally rabid hypocrites. They verbally abuse, racially incite, and blatantly abuse those that oppose their myopic poltiical views. They then shamelessly vilify the Republican party for hate speech? I have lived through many a violent 'civil rights' riot; why were these dissenters and protestors 'allowed' (even encouraged) to be angry, violent, as they burned down our cities, never held to account? Yet everyone else is expected to play patty-cake and nicey nice with those they oppose and are actively robbing our present and future liberties, curtailing our right to disagree, and looting our bank accounts? I certainly do not advocate violence, but a passion filled discussion, civil disobedience, and demand for our voices to be heard is not only healthy and protected speech, it is our CIVIL RIGHT and obligation under a democracy. We must send the message to Obama that we are not intimidated by him or his ilk. Today, in reference to the Tea Party protests, laughed, and said 'you would think they would be thanking us'. His arrogance is only eclipsed by his lack of common sense and critical thought.

It starts with Voting. Voting is a crime (see 14th amendment Sec 2). Stop supporting the fraud (stop voting), this would end the game in one fell swoop. Just think what would happen if they held an election, and nobody showed up!!
No election (votes), no "winner". "Stopping" paying taxes is more difficult, especially if one is an "employee", and the employer deducts before one ever see's it. The only solution to that is to not "file". So, stop voting and filing is the beginning of the end to their enslavement game.

What you mean to say is Dont file taxes on April 15th.

I haven't filed since 1992 nor will I ever no matter what. The IRS is simply a ficticious organization that does not exist in my eyes. The IRS and those they work for actually come out on top fiscally when I do not file.

To engage me in legalities whether it is law suits or criminal prosecution will actually cost them more than to just not bother with me.

If they do wish to engage me in a frivalous legal battle, I will hit them with the "Taxation without Representation" Constitutional violations they participate in.
